General Terms and Conditions

GENERAL CONDITIONS OF SALE

These General Terms and Conditions of Sale (hereinafter the "General Terms and Conditions of Sale") exclusively govern sales made on the website www.atelierdepimpernel.com and www.pimpernelcreations.com of products offered by Atelier de Pimpernel to buyers and specify in particular the conditions of ordering, payment, delivery and management of any returns of Products ordered by Customers.

Orders that can be placed on the Atelier de Pimpernel websites are strictly reserved for individuals.

These General Conditions of Sale are made available to Customers on the Site where they can be consulted directly.

The General Conditions of Sale are binding on the Customer who declares having read and accepted them by checking the box “ I accept the General Conditions of Sale » before confirming your order online.

Any order placed on the Site constitutes the formation of a contract concluded remotely between the Customer and Atelier de Pimpernel, and necessarily implies the irrevocable acceptance by the Customer, without restriction or reservation, of the General Conditions of Sale applicable at the time of validation of the order on the Site.

Atelier de Pimpernel reserves the right to modify its General Terms and Conditions of Sale at any time. In the event of modification, the new General Terms and Conditions of Sale will only apply to sales made after the modification. The nullity of a contractual clause does not entail the nullity of the General Terms and Conditions of Sale as a whole. The temporary or permanent non-application of one or more clauses of the General Terms and Conditions of Sale by Atelier de Pimpernel cannot be considered a waiver on its part of the application of the other clauses of the General Terms and Conditions of Sale which continue to produce their effects.

 

1. The Products
 

In order to allow the Customer to know the Products before placing the order, the Site www.atelierdepimpernel & www. Pimpernelcreations.com presents the characteristics of the Products offered for sale.

Photographs illustrate the products offered (hereinafter “the Product(s)”) for sale on the Site.

The Customer is invited to refer to the description of each Product in order to know its properties and particularities, in particular with regard to the characteristics sought and the desired size. Variations in color and appearance may exist between the image presented on the Site and the actual color of the Product ordered.

Each piece of jewellery purchased is accompanied by tissue paper, a rigid box signed by Atelier de Pimpernel and a guarantee signed by Atelier de Pimpernel

1.1. Availability of products

Atelier de Pimpernel makes every effort to ensure that products appearing as available for sale are actually in stock. However, in the event of a stock shortage or a wait for replenishment after the final confirmation of the order, Atelier de Pimpernel customer service will send an email to the Customer to inform them of the products that are unavailable or whose shipment will be delayed and, in this case, the estimated shipping time. In this case, the Customer will have the option of:

  • or to cancel all or part of his order: if applicable, Atelier de Pimpernel will reimburse the amount concerned within 14 days from his written notification of his wish to cancel all or part of his order. These conditions do not apply to Engagement rings produced on demand, nor to custom-made creations.

  • either to maintain your order and choose to receive the entire order, in a single shipment, when all the products ordered are available.

The offers for the sale of Products presented on the Site are valid, unless otherwise indicated, as long as the Products appear on the Site and within the limits of available stocks or possible restocking conditions. Indeed, a product may appear on the Site and no longer be available or awaiting restocking.

The Products appearing on the Site mention their immediate availability or the expected production times if they are not in stock.

The Site reserves the right to withdraw products from sale at any time.

2. Orders


2.1. The procedure

The Customer must verify that he is using a recommended browser that accepts cookies.

To order our products online, the Customer must:

  • browse the Site's online catalog

  • add the products of their choice to their basket. The Customer can access the contents of their basket at any time before confirming the order, to make any changes of their choice, if necessary (in particular, deleting the selected product or changing the quantity of the selected product)

  • then, from their shopping cart with a summary of the selected product(s), log in to their account or create one directly from the shopping cart using the identification tab at the top of the page. If the Customer has already used the services of the Atelier de Pimpernel online site, they must provide the email address with which they registered and their password. Any new customer must register on the Site by providing their email address and creating a password.

The Customer must click on “ order » to validate your selection of product(s).

To finalize the order, the Customer must, cumulatively, carry out the following 2 steps:

  1. check the box allowing him to confirm his acceptance of all of these General Conditions of Sale

  2. proceed to payment of the order online using the chosen payment method.

2.2. Execution of the order

The data communicated by the Customer and recorded by the Site when ordering constitutes proof of the transaction between Atelier de Pimpernel and the Customer. After validation of the order by the Customer, Atelier de Pimpernel sends an email to the Customer to inform him/her that the order has been registered. This email does not constitute confirmation of the order.

The sale will only be considered final after Atelier de Pimpernel has sent the Customer confirmation of acceptance of the order by email. However, Atelier de Pimpernel may be informed by the payment platform of a rejection of the payment method. In this case, despite the confirmation received, the order may not be executed by Atelier de Pimpernel, which will notify the Customer.

It is the Customer's responsibility to check that he has received the email confirming the order or informing of the unavailability of the Product. If the Customer has not received the email within 48 hours, it is his responsibility to contact the Site's Customer Service at the address atelierdepimpernel@gmail.com .

The Customer may follow the progress of his order on the Site via his personal account or by contacting customer service directly using the contact details detailed above.

Atelier de Pimpernel reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order, or for any other reason at the discretion of Atelier de Pimpernel: e.g.: abnormal nature of the order and, in particular, excessive order volume for an individual, excessively large order made for the same person via different personal accounts.

Orders are not subject to change due to their immediate execution and technical processing.

In the event of a malfunction of the Site affecting orders or transactions, or a stock shortage concerning the products ordered, Atelier de pimpernel will have the possibility of canceling the online order placed by the Customer. The latter will be informed by e-mail or SMS in order to indicate the reason for the cancellation of his order.

 

3. Prices

The sales prices for each of the Products are indicated on the Site in € (euros) and are inclusive of all taxes (“TTC”) including French VAT at the rate applicable on the day of the order.

If the VAT rate were to be modified, upwards or downwards, this change may be reflected in the price of the Products.

When ordering, the Customer is invited to ensure that the price of the Products to which he refers corresponds to the price appearing on the updated page of the Site and not on an expired page which he may have accessed via an internet search in so-called "cache" mode.

The sale price of the Product is the one in effect on the day of the order. Atelier de Pimpernel reserves the right to modify its prices at any time, while guaranteeing the Customer the application of the price in effect on the day of the order, provided that stock is available.

The sale prices of each of the Products are always understood to exclude delivery costs.

The Customer will be informed before the final registration of his order of the delivery costs (all charges included) linked to his order, and payment will be requested from the Customer for the total amount of the purchase indicated on the order validation page.

 

3. Payment Terms

By validating his order, the Customer acknowledges his obligation to pay for the Product(s) ordered by checking the box “ order with payment obligation ".

Payment is made immediately on the day the order is validated by the Customer via the chosen payment method. The existing payment methods are: Carte Bleue, Visa, Mastercard and American Express.

4.1. Security

The information transmitted by the Customer to process his order is only used in the context of his commercial relationship with Atelier de Pimpernel. In no way may this information be shared with third parties or resold. The Customer's banking information (bank cards) is only used in the context of his payment with our secure payment partners Sumup, Atelier de Pimpernel not retaining any banking information concerning the Customer.

4.2. Refusal of payment

Atelier de Pimpernel reserves the right to refuse any suspicious transaction, deleting any order record, particularly if the quantities of Products ordered are abnormally high.

Atelier de Pimpernel also reserves the right to refuse payment and thus cancel orders:

  • for an unreferenced delivery address or in a hotel or PO box,

  • in case of doubt as to the validity of the order

  • in the event that it is impossible to contact the Customer.

 

5. Delivery

5.1 Delivery date

For Products in stock, Atelier de Pimpernel undertakes to deliver orders within a period which may not exceed 14 days from receipt of the order confirmation email sent by

Ateleir de Pimpenel.

5.2 Delivery terms

The Products will be delivered by Colissimo or Chronopost to the address indicated by the Customer when ordering on the Site Atelier de Pimpernel & Pimpernelcreations

The delivery address taken into account is the one indicated by the Customer at the time of the order. Any change of delivery address made by the Customer is likely to result in an extension of the delivery time. If the change of delivery address is requested for an address outside the European Union, the delivery costs are entirely the responsibility of the Customer as well as any potential customs fees. Atelier de Pimpernel cannot be held responsible for additional costs.

Except in special cases or in the unavailability of one or more Products, the Products ordered will be delivered in one go.

Please note that it is more advantageous to group all products on a single order. If two or more orders are made on the same day for the same delivery location, Atelier de Pimpernel will not be able to group them and the shipping costs will be billed for each of them separately.

If the Products are delivered in several installments by Atelier de Pimpernel, the latter will assume, where applicable, the additional delivery costs.

5.3. Delay in delivery

In the event of exceeding the delivery deadline that had been indicated to the Customer and which is not attributable to the Customer, to an unforeseeable and insurmountable act of a third party to the contract or to a case of force majeure, the Customer may request the termination of the sale by registered letter with acknowledgment of receipt or by writing on another durable medium. To do this, he must order Atelier de Pimpernel by registered letter with acknowledgment of receipt to deliver the Product(s) within a reasonable additional period. If Atelier de Pimpernel has not complied within this period, the Customer may send a registered letter with acknowledgment of receipt serving as termination.

The contract will be considered terminated upon receipt by Atelier de Pimpernel of the letter or written document informing it of this termination, unless the order has been executed in the meantime.

In the event of termination due to late delivery of the Product(s),Atelier de Pimpernel undertakes to reimburse the Customer for all sums paid, at the latest within 14 (fourteen) days following the date on which the Customer terminated the contract.

5.4. Receipt of products

Atelier de Pimpernel invites the Customer to refuse any package that is damaged and to notify Customer Service, in writing and in detail, of the reservations made, within 3 days, while keeping proof of its writing. Failing this, Atelier de Pimpernel considers that the Customer has received the products in a condition giving complete satisfaction.

5.5. Delivery methods and rates

Atelier de Pimpernel delivers by Colissimo or Chronopost . The order is prepared within 24 working hours at our premises, it is then handed over to the carrier to the location chosen by the Customer. Delivery times are then between 2 and 7 days depending on the location. Delivery rates are calculated automatically when ordering according to the destination country, the Customer can consult this information in his basket.

5.6. Delivery abroad

As orders are shipped from France, no customs duties apply for deliveries within the European Community.

For shipping to the UK the customer is responsible for paying any custom tax.

6. Guarantees

6.1 Legal guarantee of conformity for consumer goods

To act under the legal guarantee of conformity (article L.217-3 of the Consumer Code), the Customer has a period of one year from the delivery of the goods to act. The Customer may, where applicable, choose between repair or replacement of the goods, subject to the cost conditions provided for in article L.217-9 of the Consumer Code which provides that " In the event of a lack of conformity, the buyer chooses between repair and replacement of the goods . However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is clearly disproportionate compared to the other method, taking into account the value of the goods or the significance of the defect. He is then required to proceed, unless impossible, according to the method not chosen by the buyer. »

In accordance with article L.217-10 of the same Code, "if the repair and replacement of the goods are impossible, the Customer may return the goods and have the price refunded or keep the goods and have part of the price refunded.

The same faculty is open to him:

1° If the solution requested, proposed or agreed pursuant to Article L. 217-9 cannot be implemented within one month following the buyer's complaint;

2° Or if this solution cannot be achieved without major inconvenience for the latter taking into account the nature of the property and the use that he is seeking.

However, the sale cannot be cancelled if the lack of conformity is minor.

6.2 Legal guarantee of hidden defects for consumer goods

The guarantee against hidden defects (article 1641 et seq. of the Civil Code) allows the Customer to be protected against hidden defects in the product purchased which prevent its use or affect it to such an extent that the Customer would not have purchased it or would have paid a lower price for it, if he had known about them.

The Customer has a period of 2 (two) years from the discovery of the defect to take action and benefit from the guarantee, free of charge.

The guarantee of hidden defects can be invoked provided that the defect meets the following 3 conditions:

  • To be hidden, that is to say not apparent during purchase

  • To render the property unfit for the use for which it is intended or to significantly reduce its use

  • Exist upon receipt of the purchase. It is up to the Customer to prove the existence of the hidden defect.

6.3 Implementation of the guarantee

Any Product under warranty which proves to be defective may, at the Customer's choice:

  • Be replaced subject to availability by an identical Product;

  • To be repaired depending on the degree of damage to the Product under warranty as well as the possibility of execution and the availability of spare parts.

However, Atelier de Pimpernel will not be able to accede to the Customer's choice if it entails a cost that is clearly disproportionate to the other option taking into account the value of the Product or the significance of the defect.

The Atelier de Pimpernel  warranty does not cover damage to the Products caused by accident, misuse or abuse, modification, attempted repair, negligence following purchase or normal wear and tear.

Atelier de Pimpernel warranty on the Products lasts for one (1) year.

To benefit from the guarantee, the Customer must contact Atelier de Pimpernel  Customer Service by following the following steps:

  • Have the order number and the name of the item concerned (this information is indicated on the purchase invoice);

  • Send the support request to Atelier de Pimpernel  Customer Service by email to the following address: atelierdepimpernel@gmail.com

In order to ensure rapid and quality processing of the warranty request, the Customer will specify their contact details, their order number and the name of the item concerned and will provide as much detail as possible on the problem encountered and, where possible, will attach to the email a photograph of the Product defect.

Upon receipt of this request, Atelier de Pimpernel  Customer Service will contact the Customer within 48 working hours to indicate the procedure to follow.

In the event of return of the Product by the Customer under this warranty, it will be the Customer's responsibility to return the Product by registered mail or any other secure mode of transport, Atelier de Pimpernel  not being responsible in the event of damage, loss or theft during return transport.

 

7. Out-of-Warranty Repair

In the event that the requested repair is not covered by the warranty or if the warranty has expired, Atelier de Pimpernel  will provide the Customer (subject to availability of parts) with a paid repair.

To obtain a personalized quote, the Customer can contact Atelier de Pimpernel by email at the following address: atelierdepimpernel@gmail.com by following the following procedure:

  • Have the order number and the name of the item concerned (this information is indicated on the purchase invoice sent by email after the sale and can be found under the My account > My orders tab);

  • Send the support request by email to the following address: atelierdepimpernel@gmail.com

Atelier de Pimpernel will confirm receipt of the request for a personalized quote within 2 business days. A personalized quote will be sent to the Customer by email within 8 business days of receipt of the quote request. For all types of support, the repair time is estimated at 15 days.

 

8. Right of Withdrawal

In the event that the product ordered does not suit the Customer, Atelier de Pimpernel grants the Customer a withdrawal period of 14 days following receipt.

The withdrawal period expires 14 days after the day on which the Customer, or a third party other than the carrier and expressly designated by the Customer, takes physical possession of the Product.

The right of withdrawal may be exercised within the period indicated, without having to justify oneself or pay a penalty, by sending by any written means (mail, email, fax) or via the attached form, one's desire to withdraw, free of ambiguity.

Atelier de Pimpernel will communicate to the Customer, upon receipt of the withdrawal form or the unambiguous declaration expressing its wish to withdraw, an acknowledgement of receipt (by e-mail).

It is understood that this right of withdrawal can only be exercised on products that have not yet been used or altered in any way by the Customer. The Product must be returned in perfect condition, in its original packaging and accompanied by the return slip and the delivery slip.

Return costs are the sole responsibility of the Customer. Be sure to wrap the jewelry well in tissue paper with tape to prevent it from slipping out of the box. Atelier de Pimpernel declines all responsibility in the event of damage, loss or theft during return transport.

Atelier de Pimpernel undertakes to reimburse the Customer for the amount of the product purchased no later than fourteen days from the date on which Atelier de Pimpernel was informed of the Customer's decision to withdraw. This commitment is understood to be subject to receipt by Atelier de Pimpernel of the Products or, at a minimum, proof of shipment that the Customer will send to Atelier de Pimpernel.

Atelier de Pimpernel undertakes to make the refund using the same means of payment as that used by the Customer when validating the order. Unless the Customer expressly agrees to use another means of payment and to the extent that the refund does not incur any costs for the Customer.

In the event of the Product being returned outside the aforementioned period, the Product will be reshipped at the Customer’s expense. After this period, the Product will be kept by

Atelier de Pimpernel.

NB. Engagement rings, custom-made or transformed jewelry, engraved jewelry and fully paved rings, such as the Iris and Iris Vintage Alliances, are excluded from the right of withdrawal. The latter are only eligible for an exchange.

For hygiene reasons, we do not reimburse piercings used as prostheses during our piercing workshops.


9. Intellectual Property

The Customer acknowledges that the Atelier de Pimpernel Products and the distinctive signs (image, photographs, packaging, product names, etc.) are the exclusive property of

Atelier de Pimpernel

The Customer shall refrain from any act of reproduction or use of the Product models, packaging, brands or distinctive signs, inventions, techniques or know-how used by Atelier de Pimpernel, as well as any act tending to the appropriation of these elements, whether or not they are protected by Atelier de Pimpernel by a patent, trademark, registered design or copyright.

 

10. Responsibility of Atelier de Pimpernel

Atelier de Pimpernel cannot be held liable in the event of non-performance or poor performance of the contract due either to the actions of the Client, or to the unforeseeable and insurmountable actions of a third party to the contract, or to a case of force majeure.

 

11. Dispute Resolution and Applicable Law

Sales concluded with Atelier de Pimpernel via the website www.atelierdepimpernel.com and www.pimpernelcreations.com are subject to French law.

All disputes to which this contract may give rise, concerning its validity, its interpretation, its execution, its termination, their consequences and their consequences will be submitted to the French courts.

 

12. CNIL Declaration and Personal Data

In accordance with the "Information Technology and Liberties" law of January 6, 1978, amended in 2004, this website has been declared to the National Commission for Information Technology and Liberties (www.cnil.fr) under number 2079963 v 0

Atelier de Pimpernel is responsible for processing the data collected.

The information collected is subject to computer processing intended to enable Atelier de Pimpernel to process the Customer's requests and orders, as well as to offer and inform them about our products.

They are thus used for loyalty, management and statistical analysis purposes.

The Client's personal data is kept for the period strictly necessary to achieve the purposes for each of the processing operations envisaged by Atelier de Pimpernel.

In accordance with the provisions of the Data Protection Act of 6 January 1978, amended in 2004, the Client has the right to access, modify and delete information concerning him/her that he/she has transmitted on the website www.atelierdepimpernel.com and www.pimpernelcreations.com

SPECIAL CONDITIONS APPLICABLE TO THE CREATION AND MANUFACTURE OF CUSTOM-MADE JEWELRY

You have chosen to entrust Atelier de Pimpernel with the creation of a custom-made piece of jewellery. We thank you for the trust you place in us.

Below you will find all the information relating to the process of making your jewelry, up to the delivery of the finished product:

  • First meeting (in person or by videoconference)

During this first meeting, you let us know your wishes: style, shape, color(s), size, budget, deadlines, etc. You also let us know on this occasion if you already have stones and/or materials that could be used in the context of the planned creation, or if all of these will have to be provided by Atelier de Pimpernel.

If during this appointment, stones and/or materials are handed over to Atelier de Pimpernel, a dated deposit receipt will be given to you against signature describing the items entrusted for safekeeping, accompanied by a photo.

  • Summary mail

At the end of this first meeting, Atelier de Pimpernel will send you a summary email and will begin its creation process by producing sketches. Unless you request otherwise in writing before the expiry of a period of 10 days from receipt of said email, the work of producing the sketches by Atelier de Pimpernel will be subject to a flat-rate invoice of €180 including tax.

  • Sketches

Within a maximum of 28 days from the first appointment, Atelier de Pimpernel will send you sketches of the jewel by email or text, from which you can make your choice. If none of the sketches completely satisfy you, or if you wish to make adjustments to one of them, Atelier de Pimpernel will send you a new sketch. If, despite this, your choice is still not made, but you maintain your decision to entrust your jewellery creation to Atelier de Pimpernels, a flat-rate invoice of €180 including tax will be sent to you for the first sketches.

  • Estimate

Once you have made your choice on the model of jewellery proposed by Atelier de Pimpernel, the latter will send you a quote for production, which it will be up to you, to formalize your order, to return signed. To be valid, the order must be accompanied by the payment of a deposit equal to 50% of the amount of the quote including tax.

  • Stone selection - sourcing

Atelier de Pimpernel will take care of sourcing the stone(s) needed to make your jewelry. These (excluding diamonds) will be presented to you for selection by you during an appointment to be arranged.

Once all the stones have been selected, whether they have been sourced in whole or in part by Atelier de Pimpernel, the production of your jewel will be launched. This will give rise, at the sole choice of Atelier de Pimpernel depending in particular on the complexity of the project, to the establishment of a 3D model or to a direct manual production, for final validation by you.

  • Manufacturing times

The indicative manufacturing times (excluding the month of August) are 6 to 10 weeks after validation of your final agreement on the shape and composition of your jewel.

  • Delivery

Once made by Atelier de Pimpernel, your jewel will either be handed over to you or delivered to the address you indicated. The corresponding delivery costs (including insurance) will be billed to you.

Custom-made jewellery cannot be returned or exchanged . If you wish to make a change, a new quote will be drawn up for this purpose by Atelier de Pimpernel.

  • Intellectual property

Atelier de Pimpernel retains ownership of all intellectual attributes relating to the creation of the jewel that you have entrusted to it, in particular with regard to the sketches (and any modifications) that have been sent to you. Any use or reproduction of said sketches, whatever their use and purpose, is therefore strictly prohibited.

  • Custody rights

It is your responsibility to recover the stones and/or materials that you have entrusted to Atelier de Pimpernel for the creation of your jewel and which have not been used, within a maximum period of 6 months from their deposit. After a period of one year, these will be considered as having been abandoned and may be sold by Atelier de Pimpernel ( law of December 31, 1903 ).



SPECIAL CONDITIONS APPLICABLE TO THE TRANSFORMATION OF JEWELRY

You have chosen to entrust Atelier de Pimpernel with the transformation of a piece of jewelry that belongs to you. We thank you for the trust you place in us.

Below you will find all the information relating to the transformation process of your jewelry, up to the delivery of the finished product:

  • First meeting (in person or by videoconference)

During this first meeting, you let us know your wishes: type of jewelry, shape, color(s), size, budget, deadlines, etc. You also let us know on this occasion if you would like stones and/or materials to be added by Atelier de Pimpernel.

When you hand over your jewellery to Atelier de Pimpernel, you will be given a dated deposit receipt against signature, stating the nature of the jewellery entrusted and the number of stones handed over for deposit, accompanied by a photo.

  • Jewellery and stone expertise

At the end of this first meeting, Atelier de Pimpernel will carry out an appraisal of the jewel(s) entrusted, without its being uncracked. If the appraisal requires the jewel(s) to be uncracked, the related costs will be invoiced by Atelier de Pimpernel.

  • Summary mail

Once the expertise of the jewel(s) entrusted has been carried out, Atelier de Pimpernel will send you a summary email specifying the exact nature and number of stones. If applicable, Atelier de Pimpernel will inform you of the defects presented by said stones, and of any deterioration resulting from the setting.

Atelier de Pimpernel will then begin its creative process by producing sketches. Unless you issue a written counter-order before the expiry of a period of 10 days from receipt of said email, the work of producing the sketches by Atelier de Pimpernel will be subject to a flat-rate invoice of €180 including tax.

  • Sketches

Within a maximum of 28 days from the first appointment, Atelier de Pimpernel will send you by email or text sketches of the jewel you wish to make, from which you can make your choice. If none of the sketches completely satisfies you, or if you wish to make adjustments to one of them, Atelier de Pimpernel will send you a new sketch. If, despite this, your choice is still not made, but you maintain your decision to entrust your jewel transformation to Atelier de Pimpernel, a flat-rate invoice of €180 including tax will be sent to you for the first sketches.

  • Estimate

Once you have made your choice on the model of jewel proposed by Atelier de Pimpernel, and before the uncapping of the jewel(s) entrusted is carried out, unless it has been made imperative for its (their) expertise, Atelier de Pimpernel will send you a quote for production, which it will be up to you, to formalize your order, to return signed. To be valid, the order must be accompanied by the payment of a deposit equal to 50% of the amount of the quote including tax.

This quote will not take into account the nature of the metal and the weight of the jewel(s) entrusted, they will be taken into account in establishing the final invoice.

  • Stone selection - sourcing

If necessary, Atelier de Pimpernel will take care of sourcing the stone(s) needed to transform your jewelry. These (excluding diamonds) will be presented to you for selection by you during an appointment to be arranged.

Once all the stones have been selected, the production of your jewel will be launched. This will result, at the sole choice of Atelier de Pimpernel depending in particular on the complexity of the project, in the establishment of a 3D model or a direct manual production, for final validation by you.

  • Manufacturing times

The indicative manufacturing times (excluding the month of August) are 6 to 10 weeks after validation of your final agreement on the shape and composition of your jewel.

  • Delivery

Once made by Atelier de Pimpernel, your jewel will either be handed over to you or delivered to the address you indicated. The corresponding delivery costs (including insurance) will be billed to you.

Jewellery transformed at your request is neither returned nor exchanged . If you wish to make a modification, a new quote will be established for this purpose by Atelier de Pimpernel.

  • Responsibility

In its capacity as depositary, Atelier de Pimpernel is not liable for the loss of the jewel(s) entrusted due to fortuitous events.

Atelier de Pimpernel is only required to return the jewel(s) deposited in the condition in which they are found at the time of return. Any damage that has not occurred due to its actions remains your responsibility.

  • Intellectual property

Atelier de Pimpernel retains ownership of all intellectual attributes relating to the transformation of the jewel that you have entrusted to it, in particular with regard to the sketches (and any modifications) that have been sent to you. Any use or reproduction of said sketches, whatever their use and purpose, is therefore strictly prohibited.

  • Custody rights

It is your responsibility to recover the stones and/or materials that you have entrusted to Atelier de Pimpernel for the transformation of your jewel and which have not been used, within a maximum period of 6 months from their deposit. After a period of one year, these will be considered as having been abandoned and may be sold by Atelier de Pimpernel ( law of December 31, 1903 ).
